T5 Labs files patent infringement suit against Gaikai

Gaikai has had a lawsuit filed against it by T5 Labs for patent infringement.

T5 Labs claims the cloud gaming service owned by Sony "committed and continues to commit acts of infringement” and has requested a jury trail through the Delaware court system.

The firm claims Gaikai infringed upon US Patent 8,203,568: Sharing a Graphical Processing Unit Between a Plurality of Programs. T5 stated it had previously notified Gaikai with a written notice of the infringement. T5 attempted to sue OnLive over similar matters of infringement in early 2011.

“Gaikai actively, knowingly and intentionally induces infringement of the patent by making, using, offering for sale and selling use of Gaikai’s GPU cloud with the knowledge that its customers and end users will use the Gaikai GPU cloud and with the knowledge and the specific intent to encourage and facilitate the infringing sales and uses of Gaikai’s GPU cloud through the creation and dissemination of promotional and marketing materials, instruction manuals, product manuals and technical materials,” according to the court documents.

T5 is seeking damages and is claiming monetary entitlement " for all future activity that it believes infringes on its patent," according to MCV.

Sony has refused comment on the matter.
