Motorola's injunction against 360 in Germany on hold as US judge deliberates

US District Judge James Robart has said he is "well aware" the court system is "being used as a pawn in a global, industry-wide business negotiation", between Motorloa and Microsoft.

According to The BBC, the judge, whose ruling will determine whether Microsoft will be banned from the import of Xbox 360 consoles over violating several of Motorloa's patents, said the cost of the case between the two "could finance a small country."

During the three hour hearing in Seattle, Robart said the behavior on both sides "has been driven by an attempt to secure commercial advantage. To an outsider looking at it, it has been arbitrary, it has been arrogant and, frankly, it has been based on hubris."

As a result, the judge has ordered Motorola to "hold off from enforcing the ruling," until the courts "ruled on a related complaint."

A court ruling in Germany last week found Microsoft had infringed on four of Motorola's patents, granting the company an injunction against the distribution of certain Microsoft products in the country.

Robart's ruling, which he said he still needs time to deliberate, has put a temporary stop to the injunction while he considers the arguments.
